The Litigation PR specialist

Litigation PR & Crisis Communications

The courtroom isn’t the only place a dispute is fought.

When high-stakes and complex disputes unfold, the fight is not limited to the courtroom. The court of public opinion shapes narratives and defines reputations. At Commwiser, we advise and support our clients before the dispute arises, during litigation and after it ends.

We make sure facts, not speculation, reach the public domain, so our clients can protect their standing while the dispute runs its course. We work alongside legal teams to ensure strategic alignment that builds stakeholder confidence and protects long-term business interests.

With lawyers on our team who understand litigation, judicial processes and the broader stakeholder environment, we develop communications strategies that complement legal strategy and protect our clients’ interests both within and beyond the courtroom.

The second arena

Who we work with

For those whose reputation is at stake.

  • Promoters, owners & families

Navigating succession, family business, inheritance and related disputes.

  • Companies, boards & shareholders

Facing corporate, commercial, shareholder, governance, insolvency, restructuring and other complex disputes.

  • Boards & leadership teams

Confronting regulatory scrutiny, investigations, allegations and heightened public exposure.

  • Law firms

Seeking strategic litigation communications that complement legal strategy and protect the integrity of the case.

  • Family offices

Safeguarding reputation, relationships and long-term interests.

  • Investment funds

Managing reputational exposure arising from investments, portfolio companies, disputes and regulatory scrutiny.

We work alongside clients and their legal counsel, integrating communications with legal strategy, never operating in its place.

The four stages

Four moments. One strategy.
  1. Private→Emerging

    Before the Dispute

Most disputes announce themselves early: when a partnership is breaking, a contract is breached, shareholders raise concerns, questions arise around family ownership and inheritance, or a regulator is asking questions.

We map the legal, reputational and media scenarios that could follow and assess the stakeholders involved. It gives clients a window to prepare and build a plan of action with the legal and communications team.

    • Risk mapping
    • Scenario planning
    • Stakeholder intelligence
  2. Emerging→Public

    When the Dispute Emerges

The first few days of a dispute are critical. A new filing, legal notice, allegation or any public development quickly shapes how the matter is perceived by investors, regulators, customers and media.

We work alongside legal teams to assess whether a public response is required, what should be communicated, and what should remain confidential. Where a response is appropriate, we develop the messaging, prepare spokespersons and establish clear communication parameters. Where silence is the better course, we help clients maintain that position while monitoring the evolving stakeholder and media environment.

    • Narrative development
    • Media strategy
    • Spokesperson preparation
  3. Public→Escalating

    During Litigation

Litigation can continue for months or years, and each hearing, order or filing can bring new developments to the matter. These developments affect employees, investors, customers, regulators and the wider public.

We work alongside the legal team throughout the proceedings to assess developments, determine what should be communicated and advise on when engagement with the media or other stakeholders is appropriate. We monitor the evolving media and digital environment and ensure that external messaging remains consistent with the legal position.

    • Media engagement
    • Response management
    • Digital reputation
  4. Resolved

    After the Dispute

A judgment or settlement may bring the dispute to a close, but its impact can continue beyond the proceedings. Stakeholders may continue to form their views based on what happened and what the outcome means for the organisation.

We assess the reputational position following the dispute and work with clients to determine what needs to be addressed and where confidence needs to be rebuilt. We support targeted stakeholder engagement, media and thought-leadership opportunities to help clients move the conversation forward.

    • Reputation recovery
    • Stakeholder communication
    • Rebuilding trust

The 3P framework

  • Preempt.

Seeing a crisis before it becomes one.

We identify reputational vulnerabilities before they become public and assess the issues, stakeholders and developments that could shape the organisation’s and individual’s position. We monitor early warning signs, regulatory signals, stakeholder concerns and media conversations to help clients understand where exposure may emerge and prepare for potential developments before they become a wider issue.

  • Prevent.

We step in when an issue begins to develop, working with clients and their legal teams to determine what action is needed to contain it. This involves engaging with key stakeholders, regulators or the media, addressing concerns directly and putting the right communication measures in place before the issue escalates into a wider public matter.

  • Protect.

When an issue develops into a dispute or public matter, we manage communication throughout the response while protecting credibility, stakeholder relationships and long-term reputation. We assess each development, advise on what should be communicated and when, and work alongside legal teams to ensure that external communication remains accurate, measured and aligned with the organisation’s interests.
